Privacy Policy (Effective Date 11/30/2018)

We at OhWhatAChat know you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our Privacy Policy. By using or accessing the Services, Site and/or Apps in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways. Remember that your use of OhWhatAChat’s Services, Site and/or Apps is at all times subject to the Terms of Use, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Use.

If you are an EU resident, our EU specific Privacy Policy applies to you.

This Privacy Policy covers our treatment of personally identifiable information (“Personal Information”) that we gather when you are accessing or using our Services, but not to the practices of companies we don’t own or control, or people that we don’t manage. We gather various types of Personal Information from our users, as explained in more detail below, and we use this Personal Information internally in connection with our Services, Site and Apps including to personalize, provide, and improve our services, to allow you to set up a user account, to enable you to build chatbots, to contact you and allow other users to contact you, to fulfill your requests for certain products and services, and to analyze how you use the Services. In certain cases, we may also share some Personal Information with third parties, but only as described below. As noted in the Terms of Use, we do not knowingly collect or solicit personal information from anyone under the age of 13. If you are under 13, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. This policy applies only to information we collect through the Site, Services and/or Apps and any emails, texts or other electronic communications sent through the Site or Apps. This policy DOES NOT apply to information collected offline, through any other apps or websites (including websites you may access through the Site) or by any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Site. These other websites, apps or third parties may have their own privacy policies, which we encourage you to read before providing information through them.

If you do not agree with this Privacy Policy, do not access or use the Site, Services and/or Apps. By accessing or using the Site, Services and/or Apps you agree to this Privacy Policy.

You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us, to communicate with chatbots, or to take advantage of some of our features. You may stop using the Services at any time; however, your conversation logs from communications with chatbots may remain in our records.

1. Changes to this Privacy Policy.

We may update our Privacy Policy from time to time. If we make material changes to how we treat your personal information, we will post the new privacy policy on this page. Your continued use of the Site or Apps after we make changes is deemed to be your acceptance of those changes, so please check this policy periodically for updates. The date that this Privacy Policy was last revised is identified at the top of the page. You are responsible for periodically visiting this Privacy Policy to check for any changes.

2. Information We Collect and How We Collect It.

We collect information from and about users of our Site, Services and Apps: (i) directly from you when you provide it to us; and (ii) automatically when you use the Site, Services and Apps. 

2.1 Information You Provide to Us.

When you access or use the Site, Services or Apps, we may ask you to provide personally identifiable information, such as name, postal address, email address, telephone number or any other information we might collect that is defined as personal or personally identifiable information under applicable law (Personal Information as defined above). This information may include records and copies of our correspondence (including transcripts of chats, email addresses and phone numbers), your responses to surveys; details on transactions you carry out through the Site or Apps; or your search queries on the Site. We may, in accordance with applicable law, record and maintain recordings of voice or other communications.

If you create an account on our Services to build a chatbot, through the registration process and/or through your account settings, we may collect Personal Information such as, but not limited to, your name, email address, timezone, list of Facebook Pages you own. Or, if you are an individual who communicates with chatbots that have been created using our Services, we may collect information such as, but not limited to, your name, gender, time zone, and avatar/picture. If you provide your Facebook or other third-party account credentials to us, you understand some content and/or information in those accounts (“Third Party Account Information”) may be transmitted into your account with us, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy; for example, when you log in to our Services using your Facebook Messenger account, we may receive your personal information associated with that account, such as your Facebook pages. Certain information may be required to register with us or to take advantage of some of our features.

2.2 Information Delivered to us by customers or visitors o third parties.

Customers may provide data (including data related to the visitors to their websites) to us in order for us to combine such data with our data for purposes of analyzing such combined data and providing feedback and running reports related to such combined data on behalf of our customers. We maintain records of all such analyses, feedback and reports. We may, on behalf of our customers, obtain from a third party data source commercially available information related to visitors. We maintain copies of such information. As mentioned in this Privacy Policy, we are not responsible for the privacy practices of any of our customers or any third party.

2.3 Information Collected Automatically and Tracking.

When you download, access or use the Site, Services or Apps, they may automatically collect certain information about your equipment, browsing actions, and patterns: (i) usage details (including traffic data, location data, communication data and the resources you access and use through the Site and Apps); (ii) device information (including IP address, operating system, browser type, hardware ID, mobile network information and the device’s telephone number); (iii) stored information (including metadata and other information associated with the files stored on your device, such as photographs, audio and video clips, personal contacts and address book information); and (iv) location information (including real-time information about the location of your device). If you do not want us to collect this information, do not access or use the Site or Apps or, if you have already accessed or used the Site or App, stop doing so immediately and delete any App from your device.

The technologies we use for automatic information collection may include cookies (small files sent to and stored on the computer or device you use to access or use our Site or Services or Apps) and other technologies such as pixel tags (small graphic images embedded in an email or website for purposes of tracking activities). We also may use these technologies to collect information about your activities over time and across third-party websites, apps or other online services (behavioral tracking).

Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. We honor Do Not Track signals from your browser.

We strive to provide you with choices about your personal information. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. You may be able to choose whether or not to allow the Site or Apps to collect and use real-time information about your device’s location through the device’s settings. However, if you disable or refuse cookies or block the use of other tracking technologies, some portions of the Site Apps may be inaccessible or not function properly.

2.4 Third-Party Information Collection.

When you access or use the Site, Services and/or Apps, or access their content, certain third parties, such as advertisers, analytics companies, your mobile device manufacturer, your mobile service provider, etc.. may use automatic information collection technologies to collect information about you, your computer or your device. The information these third parties collect may be associated with your personal information or your online or mobile activities over time and across different websites, apps and other online services websites. Such third parties may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

Please note that you as our customer remain solely responsible under applicable data protection law for the processing of personal data under such functionality to your user and we remain the processor of such data. The fulfillment of obligations under applicable data protection law to your users is thus solely your responsibility.

3. How we use your information

We use information that we collect about you or that you provide to us, including any personal information, to: (i) provide you with the Site, Services and Apps and their contents, and any other information, products or services that you request from us; (ii) provide feedback and run reports related to the browsing, purchasing, and online behavior and activities of your visitors; (iii) perform or deliver a service to our customers and/or provide them with maintenance or support services; (iv) undertake training and quality assurance; (v) fulfill any other purpose for which you provide it; (vi) give you notices about your account/subscription, including expiration and renewal notices; (vii) carry out our obligations and enforce our rights, including for billing and collection; (viii) notify customers when updates are available, and of changes to any products or services we offer or provide through the Site and Apps; (ix) to allow you to participate in interactive features on our Site.

The usage information we collect helps us improve our Site, Services and Apps and deliver a better and more personalized experience by enabling us to estimate our audience size and usage patterns, store information about your preferences, customize our Site, Services and Apps according to your individual interests, speed up your searches, and recognize you when you use the Site or Apps.

We do not rent or sell your Personal Information in personally identifiable form to anyone. We may share your Personal Information with third parties as described in this section:

Information that’s been de-identified: ​We may de-identify your Personal Information so that you are not identified as an individual, and provide that information to our partners. We may also provide aggregate usage information to our partners (or allow partners to collect that information from you), who may use such information to understand how often and in what ways people use our Services, so that they, too, can provide you with an optimal online experience. However, we never disclose aggregate usage or de-identified information to a partner (or allow a partner to collect such information) in a manner that would identify you as an individual person.

Chatbot Developers: ​The developers/owners of chatbots created through the Services which you communicate with will have access to the Personal Information you provide to them. For example, if you communicate with a chatbot which was created through the Services, the developer/owner of that chatbot may have access to your conversation history with the chatbot, your username, your avatar, and any other information you provide through the chatbot. In addition, the chatbot developer/owner may use a salesforce or other third party product integration to receive and process the data from your interaction with the chatbot.

Affiliated Businesses: In certain situations, businesses or third party websites we’re affiliated with may sell or provide products or services to you through or in connection with the Services (either alone or jointly with us). You can recognize when an affiliated business is associated with such a transaction or service, and we will share your Personal Information with that affiliated business only to the extent that it is related to such transaction or service. One such service may include the ability for you to automatically transmit Third Party Account Information, such as your Facebook Messenger profile information, to your Services profile or to automatically transmit information in your Services profile to your third party account. We have no control over the policies and practices of third party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such business’ or websites’ policies.

Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you; for example, we may use a payment processing company to receive and process your credit card ransactions for us. Unless we tell you differently, our agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us. Note that an “agent” may also be considered a “partner” in certain circumstances, and would be subject to the terms of the “Information that’s been de-identified​” section in that regard.

Business Transfers: We may choose to buy or sell assets, and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. ​Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

Protection of OhWhatAChat and Others: We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with law or court order; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of OhWhatAChat, our employees, our users, or others.


4. Your California Privacy Rights.

5. Data Security.

We implement measures designed to protect your personal information from accidental loss or unauthorized access, use, alteration or disclosure. However, the safety and security of your information also depends on you. We urge you to protect your user information and password and to be careful about giving out information in public areas of the Site which may be viewed by other users of the Site.

Unfortunately, transmitting information via the internet and mobile platforms is not completely secure. We cannot guarantee the security of your personal information when transmitted through our Site or Apps. Any transmission of personal information is at your own risk, and we are not responsible for circumvention of any privacy settings or security measures we provide.

Your account is protected by a password for your privacy and security. If you access your account via Facebook or another third party site or service, you may have additional or different sign-on protections via that third party site or service. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password and/or other sign-on mechanism appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account. We endeavor to protect the privacy of your account and other Personal Information we hold in our records, but unfortunately, we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.


6. Special Notice to You if You Are Located in a Country Other than the United States

If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, including those whose privacy laws may be more restrictive than U.S. law, please note that you are transferring your personal data to the United States to us. By providing your personal data you consent to that transfer. Notwithstanding, if you are a UE resident, our EU specific Privacy Policy applies to you.
